Civil Process Information
By Michigan statue the County Sheriff is required to execute civil process.The following Public Acts define duties and fees allowed:
Public Act 236, 1963
Public Act 173, 1982
Pubic Act 133, 1994
Process in civil actions may be served by any person of suitable age and discretion who is not a party nor an officer of a corporate party.
The Sheriff or other officer, serving any process or paper, shall be entitled to traveling fees for such service, from the county seat of the county in which service was made, to the place of service therein.
Presque Isle County Sheriff's Office does not provide any blank civil process forms. These are obtained from the district or circuit court in the jurisdiction in which the case arose or from the attorney's office if the suit is being handled by an attorney.
Fees for service of process are:
- Summons and Complaint $21.00
- Garnishment $18.00
- Affidavit of account and statement $21.00
- Seizure and delivery of goods - Claim and delivery $50.00
- Order to show cause $21.00
- Subpoena $21.00
- Writ, affidavit and bond - Case of attachment $21.00
- Seizure of property - Case of attachment $50.00
- Levy under writ of execution $50.00
- Notice to Quit - Landlord/Tenant $35.00
- Notice of Sale/Mechanics Lein $21.00
- Mortgage Sale $50.00
- Personal Protection Order $18.00
The current mileage rate is: .65 cents per mile.
Services fees are billed after service has been made or attempted.
